ABORTION LAW IN
Flanders, NJ

What restrictions are there for abortion in NJ?

Abortion is legal and protected as a fundamental right in New Jersey, with no gestational limits, allowing procedures throughout pregnancy. State law permits qualified healthcare professionals to perform abortions, bans parental notification requirements, and mandates insurance coverage for abortion services.

Additionally, in New Jersey, there are no legal restrictions for minors seeking an abortion; and, there is no requirement for an ultrasound to determine how far along the pregnancy is or, if the pregnancy if viable—meaning, in the uterus, with positive cardiac activity. Minors do not need parental consent or permission to obtain an abortion.

Key points regarding minors and abortion in New Jersey:

  • No Parental Consent or Notification: A minor can consent to their own health care, including abortion services, without requiring a parent or legal guardian’s permission or notification
  • Confidentiality: Healthcare professionals are bound by law. Information related to reproductive health care cannot be shared without the patient’s consent, with limited exceptions such as suspected child abuse.
  • Informed Consent: As long as the minor is capable of giving informed consent—meaning they understand the risks, benefits, and alternatives of the procedure—they are legally able to consent to the services on their own.
  • Non-Residents: These protections extend to minors traveling from other states to receive care in New Jersey.

If a minor uses a parent’s health insurance plan, the insurance company may send statements to the plan holder (the parent) that reveal the services provided, potentially compromising privacy, so patients should discuss payment options with the clinic directly.

Under NJ State Law, abortion remains legal and protected in New Jersey following the Dobbs decision, and is available through licensed providers.
